These Terms & Conditions of Sale govern purchases made through baluchie.com. Please read them carefully before submitting an order. By placing an order, you confirm that you have read and accepted these Terms.

1. Scope and Contracting Seller

Baluchie Milano is the trading name presented on this website.

The legal entity responsible for each sale, together with its registered address, company registration details and any applicable tax identification, is identified in our Legal Notice. The Legal Notice forms part of these Terms.

Products offered through this website are intended for consumers purchasing for personal use. They may not be purchased for unauthorised resale or other commercial purposes.

2. Eligibility to Purchase

To place an order, you must:

• Have the legal capacity to enter into a binding contract;

• Be at least the age of majority in your country of residence;

• Provide accurate contact, delivery and payment information; and

• Use a valid payment method that you are authorised to use.

We may decline an order when these requirements are not satisfied.

3. Products

Each product page presents the principal characteristics of the piece, including its design, materials, colour, sizing and country of origin where applicable.

We take reasonable care to display every product accurately. Colours and details may appear slightly different depending on the screen, device or display settings used.

Natural variations in fabrics, finishes and handcrafted details are not necessarily defects. They may form part of the individual character of a piece.

Product availability is not guaranteed until an order has been accepted.

4. Prices, Taxes and Duties

Prices are shown in the currency selected for the relevant market.

The final amount payable—including applicable taxes, delivery charges and any other disclosed costs—will be presented before the order is submitted.

Taxes and import duties are included only where this is expressly stated at checkout. Where they are not included, the recipient may be responsible for charges imposed by the destination country.

We may change prices at any time, but changes will not affect an order already accepted, except where the displayed price resulted from an obvious error.

5. Placing an Order

The presentation of products on the website is an invitation to place an order and does not constitute a binding offer.

After an order is submitted, you will receive an electronic acknowledgement. This confirms that the order has been received; it does not necessarily mean that it has been accepted.

A binding sales contract is formed when we send confirmation that the order has been accepted or dispatched.

If an order cannot be accepted, you will be informed and any amount already collected will be returned using the original payment method.

6. Payment

Available payment methods are displayed at checkout.

By submitting payment information, you confirm that the information is complete and accurate and that you are authorised to use the selected payment method.

Orders may be subject to payment authorisation, identity verification and fraud-prevention review. We may delay or decline an order if payment cannot be authorised or if additional verification is reasonably required.

7. Availability and Order Restrictions

Baluchie Milano may decline or cancel an order for legitimate reasons, including:

• Product unavailability;

• Payment or verification failure;

• Suspected fraud or unauthorised activity;

• Incorrect pricing or product information;

• Delivery restrictions;

• Unusual quantities or suspected unauthorised resale; or

• An inability to fulfil the order lawfully.

If an accepted order is cancelled, all amounts collected for the affected product will be refunded.

8. Delivery

Available destinations, delivery methods and estimated delivery times are displayed during checkout.

Delivery estimates are provided in good faith but may be affected by customs procedures, carrier disruption, exceptional demand or circumstances outside our reasonable control.

Please ensure that the delivery address is complete and accurate. We are not responsible for delays resulting from incorrect information supplied by the customer.

Risk of loss or damage passes to you when the order is delivered to you or to a third party designated by you, other than the carrier, unless applicable law provides otherwise.

9. Changes and Cancellations

If you wish to change or cancel an order before dispatch, contact Client Services promptly.

We will make reasonable efforts to accommodate the request, but changes or cancellations cannot be guaranteed once preparation or dispatch has begun.

Your statutory right of withdrawal, where applicable, remains unaffected.

10. Right of Withdrawal and Returns

Where applicable law provides a statutory right of withdrawal, you may withdraw from an online purchase without giving a reason within 14 days after you—or a third party designated by you—receive the product.

To exercise this right, you must notify us clearly before the withdrawal period expires. You may contact Client Services or use the model withdrawal form at the end of these Terms.

After notifying us, products must be returned within 14 days in accordance with the return instructions provided.

You may inspect a product as you would in a physical boutique. You may be responsible for any diminished value caused by handling beyond what is reasonably necessary to establish its nature, characteristics and fit.

Unless Baluchie Milano provides a complimentary return service or applicable law requires otherwise, the customer is responsible for the direct cost of returning a non-faulty product.

The statutory right of withdrawal may not apply to:

• Products made or personalised to the customer’s specifications;

• Sealed products unsuitable for return for health or hygiene reasons once unsealed; or

• Other products excluded under applicable consumer law.

Any additional return rights offered by Baluchie Milano are described in the Return & Refund Policy. Those additional rights do not limit mandatory consumer protections.

11. Refunds

Where a valid statutory withdrawal is exercised, eligible payments will be refunded without undue delay and no later than 14 days after we are informed of the decision to withdraw.

We may withhold the refund until the returned product is received or until evidence of return is provided, whichever occurs first.

Where required by law, the refund will include the cost of the least expensive standard delivery method originally offered. Supplementary delivery costs resulting from another delivery method may not be refundable.

Refunds are normally issued to the original payment method without an additional refund fee.

12. Faulty or Non-Conforming Products

If a product arrives damaged, defective or materially different from its description, contact Client Services promptly and provide the order details and supporting photographs where reasonably requested.

We will assess the product and provide the remedy required by applicable law, which may include repair, replacement, a price reduction or refund.

These rights are separate from the right of withdrawal. Nothing in these Terms limits mandatory legal guarantees or consumer conformity rights. Consumers in the European Union may, where applicable, benefit from a minimum two-year legal guarantee.

13. Intellectual Property

All Baluchie Milano trademarks, names, logos, product designs, photographs, films, text and other creative content remain the property of Baluchie Milano or its respective licensors.

Purchasing a product does not transfer any intellectual-property rights. Website materials may not be reproduced, distributed, modified or used commercially without prior written permission.

14. Privacy

Personal information connected with an order is processed in accordance with our Privacy Policy and Cookie Policy.

Payment information may also be processed by authorised payment providers and other service providers necessary to complete and protect the transaction.

15. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

To the extent permitted by law, Baluchie Milano is not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made for commercial purposes.

16. Events Outside Our Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including carrier disruption, customs delay, natural events, governmental action, labour disruption, interruption of essential services or other comparable events.

We will take reasonable steps to limit the effect of such circumstances and fulfil affected orders when practicable.

17. Governing Law and Disputes

These Terms are governed by the law applicable to the contracting seller identified in the Legal Notice.

If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of habitual residence.

Before beginning formal proceedings, we invite you to contact Client Services so that we may attempt to resolve the matter directly. Consumers retain access to any courts or dispute-resolution procedures available under applicable law.

18. Changes to These Terms

The version in effect when an order is placed will govern that purchase.

We may update these Terms to reflect legal, operational or commercial changes. Updated Terms apply only to orders placed after their effective date unless applicable law requires otherwise.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.
